On July 12, the EEOC updated its position due to the evolving pandemic. Now employers are required to assess whether current pandemic and individual workplace circumstances justify viral screening testing. Possible considerations for employers include the level of community transmission, vaccination status of employees, likelihood of breakthrough infections, ease of transmissibility of current variant(s), type of contact employees have with others and potential impact on operations if an employee enters the workplace with COVID-19.
